By accessing or using xdesignlabs.co, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, do not use the site.

You may use this site only for lawful purposes and in a manner that does not violate the rights of Xceptional Design Lab or any third party. You agree not to misuse the site, interfere with its operation, attempt unauthorized access, or submit false, infringing, harmful, or unlawful content.

Information on this site is for general informational and marketing purposes and does not create a client relationship by itself. Creative, consulting, design, event architecture, and related services are subject to separate proposals, statements of work, invoices, project briefs, onboarding materials, or other written agreements.

If there is a conflict between these Terms and a signed client agreement or approved scope document, the signed or project-specific agreement will control for that engagement.

If you submit an inquiry, project brief, event brief, files, creative assets, testimonials, or other materials to us, you represent that you have the right to provide that content. You grant us a limited right to use submitted materials as reasonably necessary to review your request, communicate with you, prepare scope, and perform requested services.

Where payment functionality is made available, payments are processed through third-party providers such as Stripe. Additional payment terms, project deposits, cancellation terms, and delivery schedules may be set out in a separate proposal, invoice, or client agreement.

The site, its design, branding, text, graphics, layouts, visual elements, and original content are owned by Xceptional Design Lab or used with permission and are protected by applicable intellectual property laws.

No right, title, or license is granted to you except for the limited right to view and use the site for legitimate business purposes. Client deliverables, transfer of rights, licenses, source files, and usage rights are governed by the specific agreement for each engagement.

This site may use or link to third-party services, platforms, payment processors, maps, email providers, hosting providers, or external websites. Xceptional Design Lab is not responsible for the availability, content, terms, or practices of third-party services.

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Xceptional Design Lab disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the fullest extent permitted by law, Xceptional Design Lab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the site.

To the extent liability cannot be excluded, our total liability relating to the site will be limited to the amount, if any, you paid directly to use the site itself, excluding any amounts governed by a separate project agreement.

You agree to defend, indemnify, and hold harmless Xceptional Design Lab and its affiliates, owners, officers, contractors, and representatives from claims, liabilities, damages, losses, and expenses arising from your misuse of the site, your violation of these Terms, or your infringement of any rights of another party.

Your use of the site is also subject to our Privacy Policy, which describes how information is collected and used.

We may revise these Terms from time to time by posting an updated version on this page. Your continued use of the site after updated Terms are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws applicable in the jurisdiction where Xceptional Design Lab operates, without regard to conflict-of-law principles, except where a separate written agreement states otherwise.
